Acceptable Use Policy
This policy outlines the acceptable use of Sendexa's communication platform, APIs, and services to ensure safe and lawful usage.

1Purpose & Scope
This Acceptable Use Policy ("AUP") establishes the rules and guidelines for using Sendexa's communication platform, including SMS, WhatsApp, Voice, USSD, and other services.
By using Sendexa services, you agree to comply with this policy. This AUP is incorporated by reference into our Terms of Service.
This policy applies to:
- All users of Sendexa services
- API integrations and developer usage
- Dashboard and administrative access
- Content transmitted through our platform
2Prohibited Uses
You may NOT use Sendexa services to:
2.1 Spam & Unauthorized Communications
- Send unsolicited bulk messages ("spam") or unsolicited commercial messages
- Send messages to recipients who have not consented to receive communications
- Use purchased, rented, or third-party phone number lists
- Engage in "gray" marketing practices that bypass opt-out mechanisms
- Forge or misrepresent message sender IDs (sender masking)
2.2 Fraudulent & Illegal Activities
- Conduct any fraudulent activity, including misrepresentation of identity
- Engage in phishing, smishing, or vishing attacks
- Send messages that facilitate illegal activities
- Attempt to circumvent anti-fraud systems or security measures
- Use the platform for money laundering or terrorism financing
2.3 Harassment & Harmful Content
- Harass, defame, threaten, or stalk any person or group
- Send content that is violent, hateful, or discriminatory
- Incite violence or self-harm
- Share private information about others without consent
- Engage in cyberbullying or online abuse
2.4 Intellectual Property Violations
- Send copyrighted material without proper authorization
- Transmit trade secrets or confidential information
- Distribute software or content protected by DRM
- Violate any patent, trademark, or other intellectual property rights
2.5 System Abuse & Interference
- Attempt to reverse engineer, decompile, or hack our systems
- Introduce malware, viruses, worms, or other harmful code
- Engage in activities that disrupt, disable, or overload our services
- Attempt to gain unauthorized access to our systems or data
- Use automated tools or bots without authorization
- Resell or redistribute our services without agreement
3Content Restrictions
You may not send, transmit, or facilitate messages containing:
3.1 Adult & Explicit Content
- Pornographic or sexually explicit material
- Nude or partially nude images (unless properly licensed)
- Adult entertainment or dating services with explicit content
3.2 Regulated Goods & Services
- Illegal drugs, narcotics, or controlled substances
- Weapons, ammunition, or explosives
- Tobacco, vaping products, or e-cigarettes (where prohibited)
- Alcohol (where regulated or to minors)
- Gambling, lottery, or casino services (where prohibited)
- Financial schemes, pyramid schemes, or multi-level marketing
3.3 Deceptive & Misleading Content
- False or misleading claims
- Fake news, disinformation, or misinformation
- Impersonation of government agencies, businesses, or individuals
- Scams, fraud, or deceptive business practices
- Counterfeit goods or piracy
3.4 Sensitive Categories
Certain categories require additional verification and may be subject to enhanced review:
- Political messaging and campaigns
- Religious content and organizations
- Healthcare, medical, or pharmaceutical products
- Financial services, insurance, or investment products
- Debt collection or credit repair
4Consent & Compliance Requirements
4.1 Consent Requirements
Before sending communications, you must ensure:
- Recipients have given informed consent to receive messages
- Consent records are maintained and available upon request
- Opt-out requests are honored within 10 business days
- Message content includes clear opt-out instructions
4.2 Regulatory Compliance
You are responsible for complying with all applicable regulations, including:
- TCPA (US): Telephone Consumer Protection Act compliance
- CAN-SPAM (US): Commercial email requirements
- GDPR (EU): General Data Protection Regulation
- PECR (UK): Privacy and Electronic Communications Regulations
- Ghana DPA: Data Protection Act, 2012 (Act 843)
- Nigeria NDPR: Nigeria Data Protection Regulation
- Local regulations: Country-specific telecommunications laws
4.3 Registration & Verification
Certain use cases require additional verification:
- Long codes and verified sender IDs may require registration
- Premium or short codes require carrier approval
- WhatsApp Business requires Meta business verification
- High-volume campaigns may require additional documentation
5Enforcement Actions
If we determine that you have violated this AUP, we may take the following actions:
5.1 Warning & Education
For minor first-time violations, we may:
- Issue a written warning and educate about policy requirements
- Require completion of compliance training
- Request a plan of action to prevent future violations
5.2 Service Restrictions
For repeated or serious violations:
- Temporarily suspend message sending capabilities
- Implement rate limits or throttling on accounts
- Require pre-approval for future campaigns
- Hold funds or delay settlements pending review
5.3 Account Termination
For severe or persistent violations:
- Permanently terminate account access
- Forfeit unused credits or prepaid funds
- Report illegal activities to law enforcement
- Seek legal remedies for damages
5.4 Fees & Penalties
Violations may result in additional charges:
- Administrative fees for investigation and review
- Costs for blocking fraudulent or illegal traffic
- Penalties as specified in our Terms of Service
- Legal fees and damages for harm caused
6Reporting Violations
If you become aware of any violation of this AUP or suspect unauthorized use of our services, please report it immediately:

- Include: Description of violation, evidence, date/time, sender information
- Response: We will acknowledge reports within 24 hours and investigate
We treat all reports confidentially and may take action without revealing complainant details to the violator.
7Policy Updates
We may update this AUP periodically to address new threats, regulatory changes, or business practices. When we make changes:
- Update the "Last updated" date at the top of this policy
- Post changes on our website with 30 days' notice
- Notify enterprise customers of material changes
- Continue using the service after notice constitutes acceptance
